FreeWebFront Policies
FreeWebFront provides ecommerce hosting and e-mail services. FreeWebFront reserves the right to suspend or cancel a customer's access to any or all services provided by FreeWebFront when FreeWebFront decides that the account has been inappropriately used.

Web sites are to be used by the primary owner only. Customers are not permitted to resell, store, or give away web hosting services off of their web site to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads.

Domain pointers are to be used for the purpose of having more than one way to find the same site, not for the purpose of sharing an account among multiple sites. A domain pointer may not be set up to reference a subdirectory within an existing Web hosting account served by FreeWebFront or any other provider. Domain pointers are not to be used as a substitute for purchasing separate accounts.

FreeWebFront reserves the right to refuse service and /or access to its servers to anyone.

Adult Material & Pornography
Adult material/pornography or linking to adult material/pornography is not allowed on any of our servers. Sites containing this material will be taken offline and their accounts will be closed. It is up to the sole discretion of FreeWebFront to determine what is adult material

Spamming
Users sending unsolicted commercial e-mail (spam) will have their accounts closed.

Disclaimer
FreeWebFront will not be responsible for any damages your business may suffer. FreeWebFront makes no warranties of any kind, expressed or implied for services we provide. FreeWebFront disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by FreeWebFront and its employees. FreeWebFront reserves the right to revise its policies at any time.

FreeWebFront Customer Agreement By and between FreeWebFront ("FWF"), a subsidiary of D&D Enterprises and ("Customer"). In consideration of the mutual covenants herein, the parties agree to the following, which shall apply during the term of this agreement: 1. TERMS OF PAYMENT AND ORDER ACCEPTANCE A. All orders are subject to acceptance by FreeWebFront at its office in Santa Barbara, California. An order will be deemed accepted by FreeWebFront when FreeWebFront sends written or electronic confirmation of the order to Customer. B. Payment and Terms: Payment shall be made to FreeWebFront in the form of an automatic monthly credit card charge. This charge will occur for 24 months. No refunds will be offered to Customers that fail to notify FreeWebFront of their intent to close their account. 2. PLANS AND PRICES A. Hosting prices shall be $39.95 per month. B. Customer shall be responsible for paying all taxes of any nature which become due with regard to FreeWebFront's services, except for taxes on FreeWebFront's income, irrespective of which party may be responsible for reporting or collecting such taxes. Customer shall pay all such taxes within thirty (30) days after FreeWebFront's delivery of an invoice therefor. 3. SERVICES THAT WILL BE PROVIDED BY FREEWEBFRONT A. During the term of this agreement, FreeWebFront will provide services to Customer according to the Plan accepted by Customer. Such Plan shall be deemed incorporated by reference into this agreement. FreeWebFront and Customer shall retain copies of such Plan for future reference. On-line changes made by FreeWebFront to any Plan shall not change the terms of the Plan accepted by Customer, so long as such changes do not adversely affect the services provided to Customer under the prior Plan. In addition, FreeWebFront may increase or change the cost of any plan effective upon the date of renewal of such plan. 4. RULES AND REGULATIONS From time to time FreeWebFront may impose reasonable rules and regulations regarding the use of its services. Customer agrees that it will use FreeWebFront's services only for lawful purposes. Customer agrees that it will not transmit any material in violation of any federal, state or foreign law. The use and activity of Customer's site may be monitored by FreeWebFront in the event of a real or reasonably perceived violation of any such law. Customer agrees that FreeWebFront may, without prior notice to Customer, remove objectionable materials residing on FreeWebFront's server. Such removal shall be at FreeWebFront's sole discretion and FreeWebFront shall be the sole judge of what constitutes objectionable material. 5. LIMITED 30-DAY MONEY-BACK GUARANTEE A. FreeWebFront offers a 30-day money-back guarantee on each Plan. If Customer is not completely satisfied with the Plan within the first 30 days, after the activation of such plan Customer may cancel this agreement or such plan by notifying FreeWebFront in writing. In such case Customer will receive a full refund of any amounts paid pursuant to this agreement with respect to such plan. B. After such 30-day period, services provided by FreeWebFront to Customer shall be deemed accepted for all purposes. No claim related to such accepted services may be raised at a later date. C. FreeWebFront's liability to Customer hereunder is limited to the amount paid to and received by FreeWebFront under this agreement - for the current term. FreeWebFront is proud of its record in providing state-of-the-art, reliable services, and will use its best efforts to maintain performance at the high level to which its customers have become accustomed, but FreeWebFront makes absolutely no warranties whatsoever, express or implied, including warranties of non-infringement, merchantability, or fitness for a particular purpose. FreeWebFront cannot guarantee, and disclaims all warranties, expressed or implied, regarding continuous service, service at any particular time, integrity of data stored or transmited via its system. Neither FreeWebFront nor anyone else involved in providing services pursuant to this agreement will be liable to customer or any third party for any claims or damages of any kind (direct, consequential, special, or any other) that arise out of the use or inability to use such services, whether or not resulting from fault or negligence on FreeWebFront's part, even if FreeWebFront has been advised as to the possibility of such damages. Some jurisdictions may prohibit certain disclaimers, so the above disclaimers may not apply. Customer's local jurisdiction's laws will apply only to the extent they override this agreement. E. Customer agrees to indemnify, defend and hold FreeWebFront, and each of its officers, directors and agents, harmless from and against any and all claims, proceedings, damages, liabilities, losses, costs and expenses (including reasonable attorneys fees) arising from or relating to claims by third person or entity that relate, partially or wholly, to any acts by Customer, any materials or information transmitted by Customer or Customer's use of FreeWebFront's services. F. Content. FreeWebFront exercises no control whatsoever over the content of the information and data passing through its Internet connection. FreeWebFront makes no warranties of any kind, whether expressed or implied, as to the availability, accuracy, or content of any such information or data. Use of any information or data obtained via FreeWebFront is at Customer's own risk. FreeWebFront bears no responsibility for the accuracy or quality of information or data obtained through its services. FreeWebFront is not responsible for Telco charges. 6. FREEWEBFRONT'S PROPERTY RIGHTS FreeWebFront owns all right, title and interest in and to FreeWebFront's trade names, service marks, inventions, copyrights, trade secrets, patents, and know-how relating to the design, function, or operation of Plans and of the hardware and software systems and resources necessary to provide the individual service elements of which they consist. This agreement does not constitute a license to Customer to use FreeWebFront's trade names or service marks. Any such license must be the subject of a separate written agreement. 7. PRIVACY FreeWebFront will not monitor or disclose Customer's private email messages unless required to do so by court order or law, but FreeWebFront will cooperate with law enforcement authorities and will notify such authorities if it suspects that Customer is engaged in illegal activities. 8. CONFIDENTIALITY Customer acknowledges that by reason of its relationship with FreeWebFront hereunder, it may have access to certain information and materials relating to FreeWebFront's business plans, customers, software technology, and marketing strategies that is confidential and of substantial value to FreeWebFront, which value would be impaired if such information were disclosed to third parties. Customer agrees that it will not use in any way for its own account nor for the account of any third party, nor disclose to any third party, any such information of FreeWebFront. Customer further agrees that it will take every reasonable precaution to protect the confidentiality of such information. In the event of termination of this agreement, Customer shall return all confidential materials to FreeWebFront or destroy them, at FreeWebFront's option. The provisions of this section shall survive the termination of this agreement. Upon any breach or threatened breach of this section, FreeWebFront shall be entitled to injunctive relief. 9. RELATIONSHIP OF THE PARTIES; NATURE OF AGREEMENT The relationship between FreeWebFront and Customer is that of vendor and vendee. The parties shall not be construed as being joint venturers, franchiser/franchisee, or employer/employee. Even if Customer is an individual, this agreement is a commercial agreement entered into for business purposes, not a consumer agreement. Customer has no authority, apparent or otherwise, to contract for or on behalf of FreeWebFront, or in any other way legally bind FreeWebFront in any fashion, nor shall Customer be authorized to make any representations about FreeWebFront or its services other than to set forth the contents of this agreement, of any Plan(s) contracted for, and of any rules and regulations promulgated by FreeWebFront from time to time. . 11. TERM, TERMINATION A. Initial term. Unless otherwise terminated as set forth herein, this agreement shall be effective for the term stated in the initial order. B. Automatic renewal. This agreement shall be renewed automatically for subsequent terms of the same length unless, at least twenty (20) days prior to the next renewal date, one party gives notice of non-renewal to the other. If, prior to the renewal date, FreeWebFront tenders to Customer a copy of FreeWebFront's then-current Customer Agreement with notice that renewal is conditioned on Customer's agreement thereto, any renewal by customer will be deemed to be an acceptance of the terms contained in such subsequent Customer Agreement, rather than a renewal pursuant to the terms contained herein. Upon automatic renewal of this Agreement, the Plan(s) accepted by Customer shall be deemed to be the then-current Plan(s) most closely resembling Customer's prior accepted Plan(s), provided that such subsequent Plan(s) shall be at least as favorable to Customer as any prior Plan(s). C. Termination. This agreement may be terminated in any of the following ways: 1. By FreeWebFront, (a) upon thirty (30) days' written notice to Customer, Customer breaches any material and substantial provision of this agreement and has not cured such breach by the end of the 30 days. (b) upon five (5) days' written notice to Customer if Customer fails to pay when due any amount payable under this Agreement and such amount, plus any interest and other charges, is not paid within such 5-day period. 1. Customer, in the sole judgment of FreeWebFront, violates the accepted policy, in which case FreeWebFront may either terminate this agreement, or suspend it pending discussions with Customer. 2. Any bank draft or check delivered by Customer to FreeWebFront in payment for Products is returned unpaid and Customer fails to remedy such nonpayment within five business days; 3. Customer becomes more than sixty (60) days in arrears in payment of its account with FreeWebFront; 4. There are instituted bankruptcy or insolvency proceedings against Customer, which are not vacated within sixty (60) days from the date of filing; 5. Customer institutes voluntary bankruptcy or insolvency proceedings, or otherwise admits insolvency; 6. Customer makes an assignment of all or part of its assets for the benefit of creditors; 7. Customer assigns or attempts to assign all or any part of this Agreement without FreeWebFront's prior written approval; or 8. Customer fails to inform FreeWebFront in writing immediately on the happening of any event specified in this section; 2. By Customer, (a) immediately upon giving written notice to FreeWebFront, if 1. There are instituted bankruptcy or insolvency proceedings against FreeWebFront, which are not vacated within sixty (60) days from the date of filing; 2. FreeWebFront institutes voluntary bankruptcy or insolvency proceedings, or otherwise admits insolvency; 3. FreeWebFront makes an assignment of all or part of its assets for the benefit of creditors; or 4. FreeWebFront fails to inform Customer in writing immediately on the happening of any event specified in this section. Customer shall be responsible for all costs of collection, including reasonable attorneys' fees, incurred by FreeWebFront in connection collecting any amount under this Agreement. Customer agrees that FreeWebFront's suspension of service in connection with Customer's failure to perform any obligation shall not constitute FreeWebFront's breach of this Agreement and that Customer shall be obligated to pay all fees under the Plan(s) for the period of any such suspension. 12. NONASSIGNABILITY Customer's rights and obligations under this agreement may not be transferred or assigned directly or indirectly without the prior written consent of FreeWebFront, which consent shall not be unreasonably refused. FreeWebFront's rights and obligations under this agreement may be transferred and assigned only if such transfer or assignment does not adversely affect the services provided to Customer hereunder. 13. ENTIRE AGREEMENT; MODIFICATIONS This agreement sets forth the entire agreement and understanding between the parties and merges all prior discussion between them. FreeWebFront may make changes to this agreement upon thirty (30) days' written notice to Customer, advising of the change and the effective date thereof. Utilization of FreeWebFront services by Customer and/or its Customers following the effective date of such change shall constitute acceptance by Customer of such change(s). Otherwise, this agreement may not be modified except by the of written consent of both parties.
